These Terms of Service (“Terms”) govern your use of hosting, domain, and related services provided by KellerNetwork (“we,” “our,” or “us”). By purchasing or using our services, you agree to these Terms. If you do not agree, you may not use our services.

1. Services

KellerNetwork provides web hosting, domain registration, VPS, and related services as described on our website or client portal. We may update or modify services at any time to reflect improvements, changes in technology, or compliance with legal requirements.

2. Accounts & Eligibility

  • You must be at least 18 years old to register.
  • You agree to provide accurate, complete, and current information.
  • You are responsible for maintaining the security of your account and password.

3. Payments & Billing

  • Services are billed in advance according to the billing cycle you select.
  • Payment methods may include credit/debit card, PayPal, or other options listed in the client portal.
  • Late payments may result in suspension or termination. A late fee may apply.
  • All payments are non-refundable unless required by law or expressly stated otherwise.
  • Prices are subject to change with notice. Existing contracts are not affected until renewal.

4. Cancellation & Termination

  • You may cancel services at any time through the client portal. Cancellations take effect at the end of the current billing period unless otherwise agreed.
  • KellerNetwork may suspend or terminate services immediately if you:
    • Fail to pay invoices,
    • Violate the Acceptable Use Policy (AUP),
    • Engage in illegal or abusive activity.
  • No refunds are provided for accounts terminated for violation of these Terms.

5. Acceptable Use

You agree to comply with our Acceptable Use Policy (AUP), which prohibits illegal activity, abuse of resources, spamming, copyright infringement, and other misuse. The AUP is incorporated into these Terms by reference.

6. Domains

  • Domain registrations and renewals are non-refundable.
  • You are responsible for ensuring domain renewals are paid on time.
  • Registrations are subject to ICANN and registry policies.
  • Chargebacks may result in loss of domain ownership.

7. Service Level Agreement (SLA)

We aim to provide 99.9% uptime on hosting services. Details of uptime credits, exclusions (maintenance, force majeure, customer actions), and claims are provided in our Service Level Agreement (SLA).

8. Support

  • Support is available through the KellerNetwork client portal.
  • Our support covers server and hosting-related issues.
  • Assistance with third-party software, custom coding, or applications is not guaranteed.

9. Backups & Data

  • Customers are responsible for maintaining backups of their own content.
  • KellerNetwork may provide backups as a courtesy but does not guarantee availability or completeness.
  • We are not responsible for data loss.

10. Security & Network Use

  • You may not attempt to bypass security, access unauthorized systems, or disrupt our network.
  • KellerNetwork may cooperate with law enforcement in investigating illegal activity.
  • Abuse of bandwidth, storage, or other resources may result in suspension.

11. Intellectual Property

  • You must only host or distribute content you have rights to.
  • Hosting pirated software, copyrighted works without authorization, or other infringing material is prohibited.

12. Limitation of Liability

  • Services are provided “as-is” and without warranties.
  • To the maximum extent permitted by law, KellerNetwork is not liable for indirect, incidental, or consequential damages.
  • Our total liability for any claim is limited to the amount you paid for the service in the last 3 months.

13. Indemnification

You agree to indemnify and hold harmless KellerNetwork and its affiliates from claims, damages, or expenses arising from your use of our services or violation of these Terms.

14. Legal & Governing Law

  • These Terms are governed by the laws of the State of Tennessee, USA.
  • Any disputes shall be resolved in courts located in Lebanon, TN.

15. Changes to Terms

We may update these Terms at any time. Updates will be posted on our website or client portal. Continued use of services after changes take effect constitutes acceptance.
